These Terms of Service ("Terms") govern your access to and use of the Pintone platform provided by Canda Digital Limited ("we", "us", or "our"). By accessing or using Pintone, you agree to be bound by these Terms. If you do not agree, you may not use the platform.

Acceptance of Terms

By creating an account, accessing, or using the Pintone platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Pintone on behalf of a government agency or organization, you represent that you have the authority to bind that entity to these Terms.

Description of Service

Pintone is an AI-powered platform designed for governments and organizations to create, manage, and optimize migration awareness campaigns on social media. Our services include AI-driven content generation with A/B variant testing, audience segmentation, tone-safe content validation, campaign analytics and AI insights, and integration with third-party platforms such as Meta and Canva. We reserve the right to modify, suspend, or discontinue any aspect of the platform with reasonable notice.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account access
• Promptly notify us of any unauthorized use of your account
• Not share account credentials with unauthorized individuals
• Ensure all users within your organization comply with these Terms

Acceptable Use

You agree to use Pintone solely for creating legitimate migration awareness and information campaigns. You shall not:

• Use the platform to create misleading, harmful, or discriminatory content targeting migrants or refugees
• Generate content that violates human rights principles or promotes xenophobia
• Attempt to circumvent the platform's tone-safety features or content guidelines
• Use the platform for purposes unrelated to migration awareness campaigns without prior written consent
• Reverse engineer, decompile, or attempt to extract the source code of our AI models
• Use automated tools to access the platform beyond the provided APIs
• Violate any applicable laws, regulations, or third-party rights

Intellectual Property

The Pintone platform, including its AI models, algorithms, user interface, and documentation, is the intellectual property of Canda Digital Limited and is protected by copyright, trademark, and other intellectual property laws. Content generated by the platform using your inputs is owned by you, subject to a non-exclusive license granted to us for platform improvement purposes using anonymized data. Your strategy documents, tone of voice guidelines, and campaign materials remain your exclusive property.

Limitation of Liability

To the maximum extent permitted by law, Canda Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Pintone. Our total liability for any claims arising under these Terms shall not exceed the amount paid by you for the service during the twelve (12) months preceding the claim. AI-generated content is provided as a tool to assist campaign creation and should be reviewed by qualified personnel before publication. We do not guarantee the accuracy, cultural sensitivity, or effectiveness of AI-generated content.

Termination

Either party may terminate the subscription in accordance with the terms of your service agreement. We may suspend or terminate your access immediately if you breach these Terms, use the platform for prohibited purposes, or fail to pay applicable fees. Upon termination, your right to use the platform ceases and your data will be handled in accordance with our Privacy Policy and data retention schedule.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Cork, Ireland. For users within the European Union, nothing in these Terms affects your rights under mandatory consumer protection legislation.
